Chapter 8 - THE CASE AND THE CUSTODY FIGHT

Melissa was charged based on the conduct investigators could support.

I won’t pretend every allegation became a conviction.

Courts are not novels.

There were hearings.

Evaluations.

Expert reports.

Delays.

Arguments about intent.

Arguments about context.

Eventually, Melissa entered a plea resolving criminal charges connected to the physical assault and child endangerment.

The sentence included incarceration followed by strict conditions.

Separate family-court proceedings determined contact with Emily.

Initially:

No unsupervised contact.

Then professionally supervised therapeutic contact only if Emily’s clinicians believed it appropriate.

Emily refused at first.

Nobody forced immediate reconciliation.

The court recognized that parent-child relationships matter.

It also recognized that safety matters.

Those two truths had to coexist without one swallowing the other.

The divorce became final eleven months after the backyard incident.

The signed papers I had waved in Melissa’s face on day one did not magically end anything.

There were filings.

Property division.

Attorneys.

Mediation.

Our house was sold.

I moved with Emily into a smaller place near her school.

Three bedrooms became two.

Large yard became a small fenced patio.

Emily loved it.

“Why?”

I asked.

She pointed at the sliding door.

“I can see the whole yard from inside.”

I understood.

No blind corners.

No isolated shed.

No place where punishment could disappear from view.

Architecture can become emotional.

I had never known that.
