Chapter 8 - THE TRIAL

Javier refused a meaningful plea.
He believed the power of attorney protected him.
It did not.
An agent under power of attorney owes fiduciary duties.
Self-dealing isn't magic because someone signed paper.
At trial, prosecutors presented:
bank records,
investment transfers,
false medical paperwork,
Daniel’s recordings,
garage photographs,
texts,
Lakeshore documents,
Dr. Crane’s billing,
the attempted home-equity loan.
Dr. Crane testified under her own agreement.
She admitted she never personally examined me.
She relied on family questionnaires and a brief file review.
Her license became a separate matter.
Mateo testified too.
Then Gabriela.
Hardest day of my life.
She sat on the witness stand and admitted:
“I knew my father was competent.”
Silence.
“Then why did you sign the questionnaire?”
“I wanted the court to believe he wasn’t.”
“Why?”
“So Javier could control the house and money.”
No excuses.
Good.
Then the prosecutor asked:
“Did you know your father was being kept in the garage?”
“Yes.”
“Did you open the door?”
“No.”
“Why?”
Gabriela cried.
“Because I was afraid my husband would leave me.”
I looked down.
The truth sounded even worse in a courtroom.
The jury convicted Javier on multiple fraud, exploitation, theft, and abuse-related counts based on the case presented.
Not everything prosecutors charged.
Enough.
He received a substantial prison sentence.
Restitution ordered.
Lakeshore dissolved.
Assets seized where traceable.
Gabriela faced lesser charges and ultimately received a sentence shaped by her cooperation, restitution, and role.
Some custody.
Probation.
Financial penalties.
Mandatory counseling.
No easy escape.
I did not ask the judge to spare her.
I did not ask the judge to punish her more.
I submitted a victim statement.
One paragraph:

My daughter is still my daughter. She is also an adult who helped take my money, my freedom, and my sense of safety inside my own home. I hope accountability becomes the place where she finally learns the difference between loving someone and obeying them.
That was all.
