Chương 5 - WHY THE PROJECT WAS REALLY FAILING

The independent audit took six weeks.

The results destroyed the story Lorraine had been telling everyone.

Mercer Harbor had not collapsed because of inflation.

Not primarily.

Not because of interest rates.

Not because of supply chains.

More than $21 million had moved through inflated or duplicate procurement contracts.

Another $9 million went to “marketing and development consultants” tied to Lorraine’s brother.

Four million paid for furnishings that could not be located.

Six million had been transferred between Mercer entities without lender approval.

The bridge loan was not going to rescue a fundamentally sound project.

It was going to fill a hole created partly by self-dealing.

And my name was supposed to help certify the hole as construction cost.

My design expertise became evidence.

I sat with auditors for three days.

“This stone is duplicated.”

“This lighting package was superseded seven months before the invoice.”

“This furniture supplier is billing twenty percent more units than the approved layout could use.”

“How do you know?”

“Because chairs occupy physical space.”

Apparently financial fraud occasionally lost arguments to geometry.

The report went to the lender.

Then prosecutors.

Lorraine blamed her brother.

Her brother blamed procurement staff.

Procurement staff produced emails.

Lorraine.

Always Lorraine.

Owen had known some.

Not all.

Enough.

He resigned from Mercer Development before the board could remove him.

Then something unexpected happened.

The company did not collapse.

A restructuring firm came in.

The board removed Lorraine from executive authority.

Mercer Harbor entered court-supervised restructuring.

A new investor acquired the viable project assets.

Construction continued.

Employees kept working.

The Mercer name disappeared from the building.

Lorraine called it theft.

I called it consequence.

The property opened two years later under a different brand.

With exactly 438 guestroom lounge chairs.

I checked.

Petty.

But satisfying.

My divorce from Owen proceeded separately.

He did not contest the Savannah condo.

He could not.

The deed was clear.

The gift letters clearer.

The reimbursement agreement unsigned.

Lorraine tried to claim Owen had been under family pressure when making the gift.

Rebecca responded:

“Generosity is not legally reversible because a later fraud plan failed.”

I liked that sentence.

Owen also did not fight over ordinary marital property.

At one settlement meeting, he said:

“I’m not taking another thing from her.”

Lorraine was not present.

Good.

Then investigators charged her.

Bank fraud conspiracy.

Wire fraud.

False statements related to financing.

Several counts tied to vendor schemes.

Her brother too.

Owen faced exposure for attempted bank fraud and conspiracy because he knowingly tried to obtain my guaranty under materially misleading circumstances.

His lawyer could have fought.

Instead, Owen cooperated.

Not immediately.

Eventually.

He provided emails.

Messages.

The original SAVANNAH group chat.

There it was.

Three members:

Lorraine.

Owen.

Richard Pell.

The chat began six months before our wedding.

One message from Lorraine:

Condo must title to Mara cleanly first. If she senses business purpose, she may involve Daniel.

Owen:

She won’t. She thinks it’s a gift.

I stopped reading.

Rebecca asked:

“Want me to continue?”

“Yes.”

Another:

Lorraine:

Phase 3 after wedding. Keep tone romantic.

Owen:

This feels insane.

My heart stopped.

Lorraine:

Then find twelve million yourself.

Owen:

I don’t want her exposed.

Lorraine:

She won’t be. We refinance before anyone collects.

Owen:

And if we don’t?

Lorraine:

Then the marriage ends and we settle. She still leaves richer than she started.

Owen responded:

Fine.

One word.

Not coercion.

Not innocence.

Choice.

I closed the file.

That word became the reason I eventually stopped wondering whether I should give him another chance.

Fine.

He had measured my future.

Decided the risk was acceptable.

May you like

And pressed send.
